These Terms govern the conditions of the sale, and, any other related Agreement or legal relationship with the Owner in a legally binding way.

GENERAL CONDITIONS OF SALE
These General Conditions of Sale govern the methods of sale of the goods and services (hereinafter also referred to as products) marketed and sold by Geneye LLC and regulate the purchase and sale contracts of products stipulated on this website www.generationeyewear.com and connected domains: (hereinafter also referred to as the Customer). These general conditions can be updated or modified at any time by Geneye LLC, which will communicate them according to the times and methods that will be defined unilaterally by Geneye LLC itself at its sole discretion. The consumer is required to read and fully accept these conditions and any communications before making any purchase. These premises are an integral and substantial part of every product purchase contract stipulated on the website www.generationeyewear.com and related domains.
OBJECT OF THE ONLINE CONTRACT AND ITS DEFINITION
"On-line" sales contract means the distance contract or the legal transaction having as object movable goods and / or services stipulated between the supplier Geneye LLC and the consumer (hereinafter the "Customer") in the context of a distance selling system organized by the supplier who, for this contract, uses in a prevalent but not exclusive form, the distance communication technology called "internet". All contracts, therefore, will be concluded, unless otherwise agreed, directly through the access by the consumer to the corresponding website, where, following the indicated procedures, he will conclude the contract for the purchase of the goods.
METHOD OF PURCHASE
a. The purchase of the products is made by the Customer at the price indicated at the time of sending the order confirmation. Before confirming the purchase, the customer will be summarized the cost of each product chosen, the total cost in case of purchase of multiple products and the relative shipping costs if any. By confirming the purchase, the transaction is completed. In case of temporary unavailability of the ordered products, the Customer will be promptly notified and will have the right to choose whether to complete the purchase or to renounce it or to modify the order. The payment of the purchased products and the relative shipping costs, if any, must be made by the Customer using the payment instruments indicated in the following section (called “Payment methods”). Geneye LLC, doing business as Generation Eyewear reserves the right to confirm or modify the prices of products not available in stock at the time of the Order Confirmation based on the current price lists, the publication of which cancels and completely replaces the previous price lists. A contribution for shipping costs might be added to the total amount of the order. The contribution varies according to the destination.
b. The customizations requested by the customer regarding prescription lenses and colored filters such as gradation, coloring, thickness, various treatments and shaping of the lenses themselves, in addition to any other changes expressly requested on each part of the ordered goods must necessarily be confirmed in writing by email or while placing the order; the customer must be in possession of any medical prescription, which must be sent to the company before the execution of the order. The lenses will be mounted exclusively by optometrist technicians on the chosen glasses, Geneye LLC will not be liable for any errors in the indication of the personalization communicated by the customer.
METHOD OF DELIVERY
The delivery of the products will take place during business days. The couriers used do not make preventive phone calls or handle requests for shipments at particular times. Indicatively, without this implying any constraint and without prejudice to the availability on the market of the products, in addition to any causes of force majeure, the goods will be delivered to the courier within 5 to 7 business days, from the first business day following the date of receipt of payment. Delivery times and related costs depend on the availability of the product, the shipping methods and the chosen carrier. Indicatively, for most destinations, the delivery takes place within 7 days from the departure of the goods. The Customer is required to verify that the package is intact, not damaged or wet and only after this verification the Customer must accept the delivery, after which he will not be able to make any objection about the external characteristics of what has been delivered to him in relation to the order placed. For the items indicated in the previous article sub b, the customer will directly collect them, also by courier.
PAYMENT METHODS
For online purchases Geneye LLC accepts the following payment methods:
Credit card, Debit card, Visa, Mastercard, Discover, Apple pay, American Express, Paypal, Venmo.
LIABILITY
Geneye LLC assumes no responsibility for inefficiencies due to force majeure and / or unforeseeable circumstances such as accidents, thefts and / or robberies to the person in charge of delivery, fires, explosions, strikes and / or lockouts, earthquakes, floods and other similar. events that prevented, in whole or in part, the execution of the contract within the time and method agreed upon. Geneye LLC will not be liable to any party for damages, losses and more generally costs, whether these direct or indirect items, suffered as a result of the non-execution of the contract for the aforementioned causes, having the Customer only entitled to the compensation provided from the shipping insurance itself. Geneye LLC is also not in any case responsible for damages and lost earnings, whether direct or indirect,
DEFECTIVE ITEMS
The products purchased are subject to the rules of the Consumer Code and, for what is not contemplated therein, to the specific provisions on the subject by the Civil Code. These warranties will apply to products that show lack of conformity. As required by law, the lack of conformity is covered by a 24-month warranty. Geneye LLC provides, at no cost to the customer, to restore the conformity of the product by replacing or refunding it.
Defective goods must be returned accompanied by the original invoice and a completed copy of the Withdrawal / Return Authorization number that the Customer is entitled to ask via the following email address: shop@generationeyewear.com
RIGHT OF WITHDRAWAL
Geneye LLC acknowledges the Customer to withdraw from the purchase contract by sending the purchased products, no later than 30 (thirty) days from the date of the aforementioned purchase, at Fabbricatorino Via Lagrange 29 int courtyard 10123 Turin, with the specification that shipping costs for returning the products themselves will be entirely borne by the customer.
Geneye LLC reserves the right not to refund the price if the goods are returned with damage due to misuse or incorrect maintenance.
JURISDICTION AND COMPETENT COURT
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated "on line" through the Geneye LLC website is subject to the Californian jurisdiction; these general conditions refer, although not expressly provided therein, to the provisions of the Consumer Code. For any dispute between the parties regarding this contract, the Court of Los Angeles, United States will be competent.
